2. Data processing framework
The following personal data is processed by Fleetboard Logistics GmbH within the framework of the HABBL portal use..
a) categories of personal data
- username, password
- Name, first name
- Contact details (e-mail, telephone)
- Company affiliation,
- address data,
- Log files,
- statistical data,
- Date, timestamp
b) sources of the data
The data come from the following sources:
- From you, the HABBL portal user himself,
- From your employer the company administrator
c) duration of data
Within the HABBL portal, the consignment-related data received is only stored until the tour is marked as completed or cancelled and then for another 60 days in direct retrieval by the authorized PORTAL user.
Within the PORTAL archive it is possible to display shipment data for 12 months. In order to fulfil tax documentation obligations, which depend on the respective country of the PORTAL user, the shipment data must be exported by the PORTAL user in a suitable manner.
System-related data such as user profile data as well as login data will be stored on the server for 1 year beyond the period of PORTAL use (to defend against recourse claims, renewed login to the HABBL system). However, this data is already blocked after the termination of use.
All other data will be destroyed or deleted as soon as they are no longer relevant for the performance of mutual obligations
d) purpose of the data processing
These personal data are processed for the following reasons:
- Fulfilment of the mutual obligations arising from the HABBL portal user contract,
- Fulfilment of the mutual obligations arising from the terms of use HABBL portal,
- Further development and improvement of the HABBL portal
e) the legal basis of the processing
The legal basis for data processing is derived from the following articles of the GDPR:
The processing of the HABBL portal user data is based on Article 6 para. 1 lit. b GDPR. This states that data processing is lawful and permissible, particularly in the context of contract performance.
The contractual partners are the companies of the HABBL portal users and Fleetboard Logistics GmbH.
Furthermore, the processing may be based on the so-called legitimate interest of article 6 paragraph 1 lit. f GDPR. Fleetboard Logistics GmbH has a legitimate interest in countering recourse claims and ensuring a high level of security of its own IT systems. Furthermore, there is a legitimate interest in the further development and improvement of the systems.
3. Passing on and foreign reference
a) recipient of the data
As provider of the HABBL app and operator of the HABBL portal, Fleetboard Logistics GmbH is the recipient of the processed data. A data transfer to third parties in the sense of the GDPR, which are not members/users of the HABBL app and the associated HABBL portal, does not take place through Fleetboard Logistics GmbH.
However, due to various export interfaces, the possibility of data transfer by other HABBL users (companies, forwarding agents, transport companies) may occur. However, Fleetboard Logistics GmbH has no influence on this, as these exports are necessary for the fulfilment of storage obligations. The exporting user is responsible for any transfer of data after an export from the HABBL portal.
Should a criminal investigation authority demand the surrender of personal data under presentation of an appropriate legal document (e.g. criminal prosecution order/warrant of arrest) and should Fleetboard Logistics GmbH be obliged to cooperate, the data processing will be carried out on the basis of Art. 6 para. 1 lit. c GDPR.
b) transfer to a third country (country outside the European Community)
Your data originating from the HABBL portal is stored exclusively in databases located in the territory of the Federal Republic of Germany. They are therefore subject to the EU Data Protection Basic Regulation and the Federal Data Protection Act.
Fleetboard Logistics GmbH will not transfer data transferred to HABBL server to third parties outside the European Union and the extended economic area of the EEC.
This does not apply if you as a HABBL portal user access the database from a third country. In this case you are responsible for the legality of the data transfer in your country.
4. Rights of data subjects
With regard to your personal data, you have the right of access, deletion (this may be opposed by legal retention periods), restriction of processing or the right to object to processing; you also have the right to data transferability.
You may revoke any consent you have given within the meaning of Art. 6 Paragraph 1 letter a or Art. 9 Paragraph 2 letter a GDPR at any time, without affecting the lawfulness of the processing carried out on the basis of the consent until revocation. We will be happy to inform you about the possible consequences of revocation in specific cases.
You can assert your rights at any time against our data protection officer. You can also contact the data protection officer of your company, who is also informed about data processing in connection with the PORTAL use.
